ANN ARBOR CHARTER TOWNSHIP
BOARD OF TRUSTEES MEETING
AUGUST 19, 2002


The regular monthly meeting of the Ann Arbor Charter Township Board of Trustees was called to order by Supervisor Langford at 7:30 p.m. at the Township Hall, 3792 Pontiac Trail, Ann Arbor, MI 48105.

Present: Supervisor Elizabeth Langford, Clerk Catherine Braun Treasurer Virginia Forshee, Trustees Della DiPietro, John Allison, Richard Dieterle and Michael Moran. Also present Attorney Sandra Sorini, Engineer Roger Gaugler, Fire Chief Rick Ericson, Zoning/Building Inspector Gary Dresselhouse, Utilities Director Rick Judkins.

Citizen Participation: Fred Hankin, Richard Enter, Barbara Stockton, Claudia Sedmak, Lillian Miller, Barbara Cavin all spoke about appointing Michael Moran as the replacement Supervisor.

Amend Agenda: Allison moved to amend agenda to add a new Item J - Request for funding for a farmland valuation study. Moran supported and motion carried. With present J. Discussion of non-agenda items made item K.

July 15, 2002 Minutes: Allison moved approval of the July 15, 2002 minutes with the following corrections: Under Planning Commission Meeting add Several Board members expressed concern over the Planning Commission decision to approve the Toyota Test road, questioning the amount of impervious surface, whether the Planning Commission had adequate information on zoning compliance and identifying safety concerns. Attorney Sorini was directed to clarify if the township had any liability for test road safety. Non-Agenda Items Braun informed the board that a petition group seeking a referendum on the May 2002 Zoning Amendments had gathered a sufficient number of signatures.

Ordinance 87-5 Blight: Allison moved approval of an ordinance to amend the Ann Arbor Charter Township Blight Ordinance on the second reading with the following clarification " In addition, a person or entity violating this Ordinance shall be responsible for payment of all direct and indirect costs and expenses which the Township incurs in connection with the violation, including reasonable attorneys' fees in an amount not to exceed that allowed by law." Moran supported.

Amendment to Zoning Ordinance: Allison moved to table amendments to Article XI,
Sec. 130.1104 of the Zoning Ordinance - parking and storage of vehicles- for Zoning Official Dresselhouse and Attorney Sorini to draft language consistent with the Blight Ordinance and other matters. Moran supported and motion carried.

Ballot Language for time periods in Zoning Ordinance: Allison moved approval of the ballot language attached for a referendum on the November Amendments Ordinance 1-01, which changed certain time limitations for zoning actions by the Planning Commission and the Township Board. Moran supported.

Allison moved approval of attached ballot language for a referendum on the May Amendments which changed certain time limitations for zoning actions by the Planning Commission and the Township Board. Moran supported.

Water and Sewer Rates: Allison moved approval of the revised Water and Sewer Rates for July 1, 2002 to June 30, 2002

WATS Membership Dues: Moran moved approval of $1,000.00 membership dues for July 1, 2002 to June 30, 2003 for the Washtenaw Area Transportation Study (WATS). Braun supported and motion carried.

Certificate of Occupancy/Instant Building Permit Fees: Moran moved approval of the Certificate of Occupancy Fees and the Instant Building Permit Application as proposed by Gary Dresselhouse with the changes suggested by the Board. Allison supported and motion carried.

Board Replacement for Township Supervisor: After discussion, DiPietro moved to appoint Michael Moran to fill the unexpired term for Supervisor, created by the resignation of Supervisor Langford, effective September 18, 2002 at 5:00 p.m. Allison supported.

Moran tendered his resignation as trustee effective September 18, 2002 at 5:00 p.m. and will send written notice to the township. The Board will have the appointment of a replacement for Trustee Moran on the agenda for the September 16, 2002 meeting. Interested persons should have their resume and letter of interest to the township office by September 10, 2002 and Allison indicated this will be posted on the web site.

Fire and Safety: Dieterle moved approval of the hiring of a replacement 6th fire fighter caused by the resignation of Ernest Close. DiPietro supported and motion carried.

Claims Listing: DiPietro moved approval of the August 1, 2002 claims listing in amount of $76,508.90 and August 14, 2002 claims listing for $215,180.99. Moran supported and motion carried.

Drain Assessments: Moran moved approval of the Resolution that Ann Arbor Charter Township agrees to pay the property owners share of the Brookwater Drain Assessment at $153.06 and the Cooch Drain Assessment at $120.36 as a general fund disbursement in lieu of placing the drain assessments on the winter 2002 tax roll. Forshee supported.

Planning Commission: Moran reported on the August 7, 2002 Planning Commission meeting.

Farmland Valuation Study: Allison presented a request from the Township Farming and Farmland Preservation Committee for approval of $2500.00 to Bosserd Appraisal Services for the purpose of appraising the value of development rights of farmland in Ann Arbor Township. Dieterle moved approval of the $2500.00 payment. Allison supported and motion carried.

Non-Agenda Items: Braun reported on the August 6, 2002 Primary Election. Allison requested copies of the petitions filed for referendum by Friends of Ann Arbor Township.
