ANN ARBOR CHARTER TOWNSHIP Public Hearing The Public Hearing to establish a lighting district for Fleming Creek Phase 2 was called to order by Supervisor Langford at 7:30 p.m. There were no comments from the public and the hearing closed at 7:31 p.m. The regular monthly meeting of the Board of Trustees of Ann Arbor Charter Township was called to order by Supervisor Langford at 7:32 p.m. at the Township Hall, 3792 Pontiac Trail, Ann Arbor, MI 48105. Present: Supervisor Elizabeth Langford, Treasurer Virginia Forshee, Trustees Richard Dieterle, Michael Moran, John Allison, Della DiPietro. Also present: Attorney Sandra Sorini, Engineer Roger Gaugler, Controller Lois Love. Absent: Clerk Catherine Braun. No one signed up for Citizen Participation for discussion of agenda items. Minutes of May 21, 2001 were corrected by Allison, adding last sentence at end of last paragraph as follows: The board tabled the request and directed the Supervisor to write Norfolk Development requesting information and a plan. Allison moved approval and Dieterle seconded. Motion carried. Allison moved to modify the agenda to add item K. Consideration of a comprehensive land use proposal for Colt Farms rezoning petition. Allison moved to amend the agenda, seconded by Moran and passed. Petition
for annexation release to City of Ann Arbor by Rudolf Steiner School for
three parcels KLB/Earhart
petition for re-zoning from RD to PUD approved by Planning Commission
on April 2 and Washtenaw Co. on May 10, 2001. Allison moved approval of
the PUD rezoning petition, area plan and wetland permit. Moran supported.
Roll Call:
Amendments to the Private Road Ordinance were discussed with particular
emphasis on changes proposed by Engineer Gaugler. Allison pointed out
that the proposed changes started with the Natural Features Committee
in an effort to reduce impermeable surfaces by lowering the required widths
of paved roads. These have been unacceptable to the Fire Chief, who was
not present at the meeting. It was decided that the Natural Features Committee,
in conjunction with At the May Board of Trustees meeting the Norfolk Development request to install a sewer line across Township property was tabled for lack of information on laboratory analysis of soil borings and well mitigation plan. At a subsequent meeting between the principals of Norfolk, ASTI and environmental attorneys representing both Norfolk and the Township, it was decided to retain an independent company for peer review of the environmental contingency plan presented by ASTI and Norfolk. ATC Associated, Inc from Novi, Michigan was retained and a presentation made by Tim Rombach, P.E. His report is on file. He noted several discrepancies and inconsistencies in the boring logs prepared by two companies, ISC and ASTI including mismatched soil sample intervals, boring termination depths and distinctly different lithological descriptions. Additionally, ISC noted fill material such as bricks and cinder blocks in locations where ASTI did not identify fill material. He stated that, based on the varying lithology, it is unlikely that the construction activities would create preferential pathways for methane migration that would pose a risk to nearby residences. There is a risk to the workers themselves. If a significant amount of methane is encountered, for instance, during subsurface activities, it is ATC's opinion that the Contingency Plan recommends reevaluation of conditions regarding exacerbation.
