ANN ARBOR CHARTER TOWNSHIP
BOARD OF TRUSTEES MEETING
MONDAY MAY 21, 2001

Supervisor Elizabeth Langford called the regular monthly Board of Trustees meeting to order at 7:30 p.m. at the Township Hall, 3792 Pontiac Trail, Ann Arbor, MI 48105.

Present: Supervisor Langford, Clerk Catherine Braun, Treasurer Virginia Forshee, Trustees John Allison, Richard Dieterle, Della DiPietro, Michael Moran. Also Attorney Sandra Sorini, Engineer Roger Gaugler and Chief Rick Ericson.

Allison moved to amend agenda to put Police Protection Committee Report on agenda as first item under Reports, Resolutions, and to move item D - Approval of Food Gatherers Annual Special Event to the next item and then continue with A-B-C.. Braun supported and motion carried.

Citizen Participation Eulalia Stewart, 2281 Ayrshire was in attendance to discuss the KLB/Earhart project.

Approval of Minutes: Allison moved approval of the April 16, 2001 minutes with the following corrections: Page 2 - Norfolk Development Company Allison requested that Norfolk provide lab analysis from soil borings. Moran supported and motion carried.

Hanlon Annexation: Moran moved approval of the Eugene F. and Judith L. Hanlon, 1700 S. State Street annexation release for municipal services. Release is contingent on payment of taxes. Parcel Code 09-32-490-002 (AZ-02-01) Allison supported and motion carried.

Severance Annexation: Allison moved approval of the Dennis G. and Camille B. Severance, 3330 Geddes Road annexation release due to a failing well. 09-26-481-001 (AZ-3-01) Moran supported and motion carried.

KLB/Earhart Rezoning Request from R-D to PUD and Wetland Permit: DiPietro stated that there is a meeting scheduled for 7:30 a.m on May 31, 2001 at Washtenaw County Road Commission regarding Old Earhart Road. The meeting will be with the petitioner, township representatives and Road Commission staff Jim Harmon, Phil Carroll and Steve Puuri. Allison moved to table the rezoning request and wetland permit to get information on the following (1) Storm Water Modeling analysis reports back from Drain Commissioner and Fleming Creek Advisory Council. (2) Ground Water Recharge documentation reviews by Gene Jaworski and Fleming Creek Advisory Council. (3) Meeting with Road Commission to minimize road speed. (4) Landscaping plan for old roadbed reviewed by a Certified Arborist. (5) Documentation of the restoration plan for Popkins School reviewed by the Historic Commission. (6) Only 510 Parking Spaces required for use as long as the building remains corporate headquarters. (7) Storm water system maintenance plan. (8) Erosion control monitoring plan. (9) Lighting plan review. (10) Paving Old Earhart to Goss Road. (11) Escrow for plant survival in roadbed. DiPietro supported and motion carried.

Police Protection Committee Report Larry Burgess Chair of the Committee reported on the written report of May 21, 200l. Rena Basch and Peter Davis members of the committee were also in attendance to answer questions from the board. Board would like an analysis of funding for the June meeting.

Food Gatherers: Margie Hagemy was in attendance to request a Special Events Permit for the Food Gatherers annual fund raising event "Grillin" on June 10, 2001 at1731 Dhu Varren Road.. Moran moved approval contingent upon receiving copies of insurance and liquor permits. Braun supported and motion carried.

2001 Road Maintenance: Allison moved approval of road maintenance on Thornoaks and East Huron River Service Drive - $16,000.00, DhuVarren west of Pontiac Trail- $7,200. The remaining budgeted balance will be used for Joy Road if an agreement can be worked out with Northfield Township or Maple Road if an agreement can be reached with Scio Township. If these agreements can not be made, limestone and grading improvements will be made to Warren Road from Earhart to Dixboro Road. Moran supported and motion carried.

Rubbish/Recycling Contract: DiPietro moved to accept Republic Waste Services proposal for a 5 year contract alternating weeks for recycling and yard waste at $42.00 a quarter. Republic will furnish recycling container and a cart rental is available at $7.50 per quarter. Forshee supported and the motion carried. Mr. Rubbish has offered the sale of the carts presently in the possession of homeowners for a cost of $35.00 each. No repairs or maintenance would be available for the used carts.

Central Dispatch Agreement: Moran moved approval of the Washtenaw Central Dispatch and Technology Authority 2001 Fire Dispatching Service Agreement. DiPietro supported and motion carried.

Claims Listings: DiPietro moved approval of the May 1, 2001 claims listing in amount of $185,014.13 and May 16, 2001 for $35,564.94. Allison supported and the motion carried.

Personnel Committee Report: DiPietro reported that the Personnel Committee had met with Kay Jordan and believed a 2% or $650.00 additional increase would be in order due to increased duties. Allison moved approval, Dieterle supported and motion carried.

Mother Teresa Private Road: Attorney Sorini stated she has not received Ave Maria Village Association incorporation establishing the Association. No action was required.

Fire and Safety: Dieterle reported on the May 2, 2001 Fire & Safety Meeting. Chief Ericson reviewed the Washtenaw Area Mutual Aid Association Standard Operating Guidelines for Automatic Mutual Aid. Permission was granted for Chief Ericson to proceed.

Huron River Watershed Membership: Moran moved approval of renewal of our membership for April 2001 to March 2002 for $472.00. DiPietro supported and motion carried.

Resolution for Reducing the Size of the County Board of Commissioners: Moran
moved to reject the Resolution, DiPietro supported and motion carried.

Planning Commission: Moran reported on the April 25, 2001 and May 7, 2001 Planning Commission Meetings.

Norfolk Development: Allison did not find the Applied Science & Technology, Inc. report responsive to the request of the last meeting for lab analysis of soil borings and for the well mitigation plan. He requested that the developer provide the following information:

1. Lab analysis of soil borings made 25 feet deep at locations spaced 50 foot apart along the line of the proposed sewer. These soil samples shall be tested for the substances listed in the following two sources: EPA persistent, bioaccumulative and toxic chemicals list and EPA Code of Federal Regulations Title 40, chapter l, subchapter I, part 261.

2. Current water test data from all five wells currently on the line of the proposed sewer.

3. A well monitoring plan to ensure that any potential groundwater contamination due to the construction of the proposed sewer is detected. An acceptable proposal would include a monitoring well near adjacent property owners wells and to the same depth This well and the five along the proposed sewer are to be monitored for a period of 6 months after the construction to ensure that no contamination occurs.

4. Appropriate bonding for remediation of adjacent wells in the event contamination occurs within 6 months after the construction

DiPietro moved to adjourn and Dieterle supported. Motion carried.
