ANN ARBOR CHARTER TOWNSHIP
BOARD OF TRUSTEES MEETING
APRIL 15, 2002

The regular monthly meeting of the Ann Arbor Charter Township Board of Trustees was called to order by Supervisor Langford at 7:30 p.m. at the Township Hall, 3792 Pontiac Trail, Ann Arbor, Michigan 48105.

Present: Supervisor Elizabeth Langford, Clerk Catherine Braun, Treasurer Virginia Forshee, Trustees John Allison, Richard Dieterle, Della DiPietro, Michael Moran. Also present Attorney Sandra Sorini, Engineer November Freece and Chief Rick Ericson.

Allison moved to amend the agenda to add a new Item I Avon Breast Cancer 3-Day Michigan walk and moved Non-Agenda Items to J. DiPietro supported and motion carried.

Public Comment: Richard Enter, 2140 Old Earhart Road spoke about the realignment of old Earhart Road, Richard Bowerman, 4419 Ford Road spoke against the request to rezone the DF Land Development property. Jeff Basch, 4260 Shetland spoke about the zoning amendment to Office Park District requested by DF Land Development stating board members should take careful consideration of all issues. Mr. Duggan, 2120 Old Earhart spoke regarding the realignment of Old Earhart.

March Minutes: Moran moved approval of the March 18, 2002 minutes. Dieterle supported and motion carried.

Annexation: Moran moved approval of the annexation request (AZ 2-02) of Robert Ufer, 1631 South State as property needs connection to city sewer and water for development and leasing to U of M School of Art and Architecture (09-33-370-003). Forshee supported and motion carried.

DF Land Development Zoning Amendment to Office Park District: Attorney Robert Carson introduced Barry Murray and Hank Byma from Smith Group JJR who presented an overview of the proposed Ave Maria University use on the property. They propose to add educational use to the office zoning to allow the academic buildings, residential use and other changes set forth in the rezoning request including doubling the FAR. Moran moved to adopt the Resolution for Denial of Zoning Ordinance Amendment, Wetland Use Permit and Natural Features Setback Use Permit for Ave Maria University attached to these minutes. Allison supported.

Open Space Preservation Residential District: Allison reviewed the recommendations of the Township Planning Commission and the County Planning Commission pertaining to the proposed ordinance. Allison moved approval of the Open Space Preservation Residential District Ordinance 1-02. Dieterle supported .

Fire Fighters contract: Dieterle moved adoption of the proposed four (4) year contract with Fire Fighters Union Local 2003 IAFF - January 1, 2001 to December 31, 2004. Allison supported. Roll Call

AW Technical Center Amendment: Al Aceves, Sr. Manager Deloitte Touche, Shigeyasu Kozaki, President AWTC and Tim Robinson, Washtenaw Development Council were in attendance to request an amendment to the Industrial Facilities Exemption Certificate approved on March 18, 2002. The change requested is to the number of new jobs which will be three (3) rather than thirty five (35) as stated in March. AWTC also suggested that a 2-year abatement period would be acceptable for the MCRS grant. DiPietro moved to approve the abatement for a period of two years for machinery and equipment, require employment of three new employees and provide for a pay back period of twice the 2-year abatement. Moran supported and motion carried.

The Ridge Private Road Permit: Connie Brown was in attendance to ask approval of the Private Road Permit for The Ridge Condominium project. DiPietro moved approval of the Private Road Permit with the variances previously given contingent upon Attorney Sorini approval of the Private Road Maintenance Agreement, meeting conditions in Engineers report of April 12, 2002 and a deposit letter or letter of credit for the road construction. Moran supported and motion carried.

KLB/Earhart approval of Old Earhart Road realignment and tree mitigation: Don Tilton was in attendance to request approval as part of the PUD for this project for the Old Earhart Road realignment and tree mitigation plan. Allison requested a table with land mark and woodland trees shown and written confirmation that Washtenaw County Road Commission has given permission to plant trees in the Old Earhart road bed. Dieterle requested more information on drainage issues.

KLB attorney Bill Barris spoke regarding the U of M sewer easement approved in October 2001. Tony Anton addressed the question about occupancy of the building. Moran moved to amend approval of the sewer easement to be conditioned on removing the words "for office building uses" from the easement, with the understanding that the language of the easement does not alter the intent of the PUD Agreement for use as a corporate headquarters Allison supported and motion carried.

Allison moved to table the approval of the landscape and road realignment plan. Moran supported and motion carried.

Voter Precinct changes: Braun explained the changes to the voter precincts and asked for board approval. Allison moved approval of the change. Moran supported and motion carried.

Claims Listing: Dipietro moved approval of the April 2, 2002 claims listing in amount $38,510.08 and the April 10, 2002 claims listing for $38,399.28. Allison supported and motion carried.

Fire & Safety: No report.

Planning Commission: Moran reported on the April 1, 2002 meeting.

Avon Breast Cancer Walk: Allison moved approval of the walk through Ann Arbor Township on May 31, 2002. DiPietro supported and motion carried. The certificate of insurance has been furnished to the township.

Non Agenda Items: Allison questioned what was being done about the abandoned buildings. Attorney Sorini said the process is going forward. Scott Munzel is working with Gary Dresselhouse on these buildings and will prepare a report and time line for board's review. Allison also said the Farm Land Preservation Committee was reviewing the draft of the Drain Tile Ordinance.

Braun requested that the township office be notified of all meeting scheduled for the township hall so the fire department can be notified. Braun also requested that people using the room put chairs back in original place and in general leave the room as they found it.

DiPietro asked for newsletter articles be given to her by end of week or at least expressed to her that there will be information for newsletter forthcoming

Public Comment: Bob White 2612 Newport Road expressed interest in the Policy Statement negotiated with the City of Ann Arbor.

DiPietro moved to adjourn. Dieterle supported and motion carried.
