ANN ARBOR CHARTER TOWNSHIP
BOARD OF TRUSTEES MEETING
MONDAY, JANUARY 21, 2002

The regular monthly meeting of the Ann Arbor Charter Township Board of Trustees was called to order by Supervisor Langford at 7:30 p.m. at the Township Hall, 3792 Pontiac Trail, Ann Arbor Mi 48105.

Present: Supervisor Elizabeth Langford, Clerk Catherine Braun, Treasurer Virginia Forshee, Trustees John Allison, Della DiPietro, Richard Dieterle, Michael Moran. Also present Attorney Sandra Sorini, Engineer Roger Gaugler, Wetland Consultant Gene Jaworski, and Fire Chief Rick Ericson.

Public Comment K. Srinivasan spoke about the proposed Ave Maria Golf Course by reading his letter to the Board of Trustees dated January 21, 2002.

Approval of Minutes DiPietro moved approval of the December 17, 2001 minutes. Moran supported and motion carried.

Public Hearing Supervisor Langford called the Public Hearing to order at 7:35 p.m. to consider a request from Burns Ridge for a Private Road Permit and a variance to same. No one spoke and hearing was closed at 7:36 p.m.

Burns Ridge Burns Ridge requested a Class B Private Road with variances for road width, curb and gutter, and horizontal curves. Chief Ericson spoke about his concerns for the request for an 18' road which is not sufficient for fire equipment Moran moved approval to grant variances for the curbs and gutter and also for the curve radius. Pavement will be 22 feet wide as a Standard Class B Road. Braun supported and motion carried.

Burns Ridge PUD Damian Farrell and Connie Brown from Damian Farrell Design Group were in attendance to answer questions. Andrea Kevrick from InSite Design Studio, Inc. the Landscape Architect compared Ann Arbor Township Mitigation Standards with Burns Ridge Proposed Mitigation.

Allison moved approval of a Resolution Approving a PUD Rezoning Petition and Area Plan for Burns Ridge (Resolution attached) DiPietro supported and motion carried.

Mother House PUD Paul R. Fransway was in attendance to request approval of the PUD Rezoning and Area Plan for the Sisters of Mary, Mother of the Eucharist for rezoning of a 20.23 acre parcel on Warren Road. DiPietro moved approval of the Resolution Approving a PUD Rezoning Petition and Area Plan for the Motherhouse.(Resolution attached.) Braun supported.

Winemaker License Michael Rae and Jacquelene Monic Strother were in attendance to request approval for a winemaker license for there residence at 739 Dhu Varren Road, Ann Arbor Mi 48105. Moran moved to table to give Zoning Administrator Dresselhouse the opportunity to review material given to board members tonight to see if this would qualify as a home occupation. DiPietro supported and motion carried.

Dilapidated Building Ordinance Moran moved to strike Section 3.1 (J). Dieterle supported. Motion failed. DiPietro moved to change (J) from 180 days to 365 days. Allison supported and motion carried. Allison moved approval of the first reading of the Dilapidated Buildings Ordinance. DiPietro supported and motion carried.

Recovery by Township for Expenses Moran moved approval of the proposed Ordinance (First Reading) to provide for the recovery by the Township of expenses for enforcing Township Ordinances. Dieterle supported and motion carried.

Ave Maria International Golf Course Hank Byma reviewed his January 9, 2002 submittal. Richard L. Burns, Vice President of NTH Consultants, Ltd. reviewed and answered question regarding his January 16, 2002 report on peer review of hydrogeologic documents for the Ave Maria Golf Course. David Hyndman, PhD reported on his review of Hydrogeologic issues related to the proposed Ave Maria International Golf Course report of January 7, 2002. Attorney Sorini reported on her review of the law in regards to Mr.& Mrs. Srinivasan easement to there residence at 4931 North Dixboro Road. Byma reviewed the conditions in the draft Resolution approving the Conditional Use Permit. Mr. Tom Stevens attorney with Olson & Bzdak spoke on behalf of Mr. & Mrs. Srinivasan. Mr. Fransway spoke regarding preserving Mr. Srinivasan ingress and egress. Allison moved approval of the Resolution Approving Conditional Use Permit and Wetland Use Permit for Ave Maria International Golf Club with changes. Forshee supported. (Resolution attached)

Fee Schedule Braun moved to table the Fee Schedule and Policy. Forshee supported and motion carried.

Sprint Site License Agreement DiPietro moved approval conditioned on Engineer Gaugler's report. Allison supported and motion carried.
